WHY WE COLLECT INFORMATION ABOUT YOU The main purpose of collecting information about you is market research. When you join us, we enter into a contract with you, which is governed by this Privacy Policy and our Rules. In order to fulfill this contract by inviting you to relevant questions, we need to collect, process and classify information that is requested at the time of recruiting new participants or that you can add to your profile on the panelist's website at a later date or the we collect and process by automated means in accordance with this Privacy Policy. This information is also required to send you awards and to contact you about surveys. This question is also explained in detail in our rules. In addition, we collect information from you with your consent, particularly when you respond to invitations to participate in surveys that we may send you or when you otherwise voluntarily provide it. Your responses to such surveys are your decision. In some situations, we may request your additional or even explicit consent when it is appropriate or necessary. This User Agreement (hereinafter 'Agreement') is a public offer by the Administrator to an individual to participate in the online polling panel 'OLE GMEDIA' (hereinafter in the text of the Agreement 'Panel', 'Site') and is deemed complete and concluded unconditionally if the natural person wishing to participate in the proposed panel accepts this by registering (hereinafter 'respondent', 'participant', 'panelist'). KEY TERMS 1. Administrator is OLE GMEDIA GmbH 2. Panel, Website is the entire content of the websites located on the Internet under this domain and its sub-domains, owned by the above-mentioned Administrator and providing the service offered by the Agreement. 3. Respondent, Respondent, Panelist is an individual who represents and warrants that he/she has the legal capacity required under applicable law to enter into this Agreement and is on the Administrator's research panel. 4. Survey, study is research into public opinion about goods, services or events, conducted by the administrator or its partners by means of an online survey of the respondent via the panel or via the partners' websites. 5. Partners are market research companies collaborating with the Panel and who are clients of the Panel's studies, with which the Administrator has concluded the necessary agreement. 6. Registration is the respondent's voluntary consent to participate in the Administrator's research panel, which is inextricably linked to creating an account in this panel and submitting the required personal data to the Administrator via the Website. 7. Personal Data - The list of all personal data provided by the Respondent and subsequently processed by the Panel Administrator and its partners in accordance with the Privacy Policy is set out in Appendix 1 to this Agreement. By entering into this agreement, the respondent unconditionally confirms and guarantees his or her consent to the processing by the administrator of the submitted personal data, including cross-border transmission via the Internet and subsequent processing by third parties - panel partners. Rewards are prizes awarded by the Administrator to the Respondent for successful participation in studies conducted by the Panel or Partners in the form of an online survey. SUBJECT OF AGREEMENT Under the terms of this Agreement, the Administrator undertakes to provide the Respondent with the opportunity to participate in surveys conducted on the Website and on the websites of the Panel's partners, provided that it has studies open to participation. The Administrator does not guarantee the Respondent a certain regular number of invitations to complete surveys. Invitations to participate are sent via notifications to all contacts provided by the respondent for this purpose: emails, mobile and messenger notifications, browser and social media push notifications and other means of communication to contacts voluntarily provided by the respondent. The panelist has the right to refuse to receive new invitations to participate in surveys at any time. The respondent, if he successfully completes the survey, will receive bonus points according to the administrator's decision, the amount of which is fully determined by the panel administrator. However, the panel administrator is not responsible for the correctness and proportionality of the awarding of points and is not liable to the respondent in the event of any claims arising from the latter. CONDITIONS FOR PARTICIPATION IN THE PANEL The administrator of the panel has the right to reject any individual respondent's application for participation (registration) in the panel or to suspend the already active membership of a panelist without giving reasons. However, the respondent has the right, but not the obligation, to participate in the surveys offered by the panel and may unilaterally opt out at any time. The respondent may only participate once in each individual survey. Repeated participation in the same study is prohibited and may result in suspension and/or deletion of the respondent's account from the panel and termination of the respondent's membership. If in a specific study the required number of responses from respondents is reached, the Administrator and Partners have the right to terminate the online survey at any stage without accepting any further responses and no longer receiving the reward for the responses to the survey to calculate. If the respondent is found to be using multiple accounts ends (multiple accounts set up to increase the number of rewards to be calculated), the administrator has the right to cancel and retain all previous and current rewards for all accounts where a violation has been determined, without the technical means to to explain the detection of such violations. This agreement prohibits the respondent from using anonymization tools such as VPNs, proxy servers and other technical means and methods when participating in the survey and logging into the panel account to obtain the IP address of the device used to participate in studies used to conceal and/or pretend. In the event of such breach, Administrator is also entitled to cancel and withhold all previously and currently calculated Rewards. If it is found that the respondent has provided inaccurate or inappropriate personal data and/or responses in panel or partner studies, the Administrator has the right to deny such participant membership in the panel and cancel all previously and currently calculated rewards and withhold. If the respondent does not participate in the studies conducted by the Panel for a period of more than six (6) consecutive months, the Administrator shall have the right to unilaterally terminate such participant's membership, including the deletion of the account established by the respondent and the cancellation of accrued rewards. USE OF YOUR PERSONAL INFORMATION The information you provide to us will be treated in the strictest confidence and in accordance with applicable laws, rules and regulations, including those relating to confidentiality, personal data and our privacy policy. This Privacy Policy is an integral part of this User Agreement. Among other things, we promise: If it is not related to this panel, we will not try to sell you anything or use information about you for marketing purposes. Your survey responses will be confidential and will only be used in conjunction with other confidential responses, unless you expressly consent to your responses to a particular survey being transmitted to the customer along with your personal information. Refusal to answer a specific question will not affect your continued panel membership. You can request to be removed from the panel at any time. You can request correction or deletion of your personal information and the information you have provided about your family at any time. You have the right to request a copy of your personal information that we hold at any time. DISCLAIMER Any indemnification by the Administrator and the Panel for any loss suffered by the Respondent as a result of this Agreement, as well as liability for breach of confidentiality obligations, is excluded and in no event shall it be liable for any intentional, incidental or consequential damages resulting from actions arising out of or related to this Agreement. The administrator is not responsible for internet failures, computer viruses or third-party interventions that may prevent or delay access to the panel or partner sites on the internet or cause other problems or losses. The Administrator shall also not be liable for any delay or failure in the performance of its obligations resulting from force majeure, including but not limited to technical failure on the part of the panel or partners, natural disasters, military conflicts, civil riots, terrorism, court orders, measures by legislative and/or regulatory authorities. Any liability of the administrator is limited to the amount of the reward.
